ABSTRAK
Pelaku pembangunan apartemen saat ini sering menggunakan strategi penjualan pre project selling melalui media iklan untuk menarik perhatian konsumen, namun seringkali masih menimbulkan permasalahan. Seperti Indonesia, Tiongkok juga memiliki permasalahan terkait perlindungan konsumen apartemen yang dijual secara pre project selling melalui iklan. Penelitian ini bertujuan menganalisis perlindungan dan penyelesaian hukum bagi konsumen pembeli apartemen yang dirugikan dalam pre project selling apartemen melalui iklan di Indonesia dan Tiongkok. Penelitian ini menggunakan metode pendekatan perbandingan dengan spesifikasi penelitian deskriptif analitis. Hasil penelitian menunjukkan bahwa perlindungan hukum melalui pengaturan terhadap konsumen pembeli satuan rumah susun yang dirugikan dalam pre project selling apartemen melalui iklan telah dilakukan di Indonesia dan Tiongkok walaupun belum sempurna, masih terdapat beberapa kelemahan. Penyelesaian hukum mengenai pre project selling apartemen melalui iklan di Indonesia dan Tiongkok agar lebih efektif dan efisien sebaiknya diselesaikan secara non litigasi, apabila tidak berhasil baru diselesaikan melalui pengadilan. Pengadilan sebagai upaya hukum terakhir karena pengadilan memiliki 2 (dua) kelemahan utama yaitu proses persidangan yang relatif lama dan peran hakim yang pasif.

ABSTRACT
Nowadays the apartment’s developers often use pre-project selling strategy through advertisement to attract consumer’s attention, however this strategy may create some problems. Similar with Indonesia, China has various problems related to consumer protection of apartments sold in preproject selling through advertisement. This research is intended to analyze the legal protection and legal settlement of consumers which buying apartment units that are harmed in the preproject selling apartments through advertisement in Indonesia and China.This research is using a comparative approach method with analytical descriptive research specification. The result showed that the legal protection by legislation for consumers which buying apartment units that are harmed in the pre-project selling apartments through advertisement in Indonesia and China both have been done but not yet perfect, there are some weaknesses. Legal settlement regarding pre-project selling apartments through advertisement in Indonesia and China should be resolved by non litigation way to be more effective and efficient, if it fails then the dispute should be resolved through the courts. The court is set as the final legal effort because it has 2 (two) major weaknesses, which are the time in process of trial and the role of a passive judge.
