Abstract

ABSTRAK
Pembahasan mengenai The Notary and Electronic Contracts menjadi salah satu pembahasan penting dalam International Congress of Latin Notaries 2004. Penelitian ini mengkaji legalitas tanda tangan elektronik dan posibilitas dan tantangan Notary Digitalization di Indonesia terkait kemungkinan pembuatan akta otentik serta penandatanganan secara elektronik sebagai suatu titik temu antara Notaris Common Law dan Civil Law, antara konsep Cyber Notary dan Electronic Notary. Melalui pendekatan yuridis normatif dengan metode deskriptif analitis ditemukan bahwa dari segi substansi, struktur dan kultur Indonesia masih memerlukan berbagai macam penyesuaian, pembaharuan maupun strategi kolaboratif untuk membentuk suatu harmonisasi dari aspek regulasi, dukungan dari insrastruktur teknologi dan SDM serta pembentukan budaya hukum bukan saja melalui tingkat pengetahuan masyarakat terhadap teknologi digital dan jabatan notaris, tetapi juga pembentukan budaya hukum berupa kepercayaan dan rasa aman (trust and security) terhadap digital environment, digital safety juga kepercayaan terhadap jabatan notaris sendiri. Ketiga hal tersebut memerlukan suatu pembaharuan yang diformulasikan dalam suatu sistem yang komprehensif, handal, terintegrasi dan aman melalui strategi kolaboratif yang didukung oleh berbagai instansi / kementerian terkait guna memperoleh titik temu, harmonisasi sekaligus best practice nya dalam pelaksanaan jabatan notaris di Indonesia.

ABSTRACT
The discussion concerning the Notary and Electronic Contracts has become one of the most important issues in International Congress of Latin Notaries 2004 especially related to the possibility and challenges of the formulation of authentic deeds and electronic signature as the intersection between common law notary and civil law notary, between cyber notary concept and electronic notary concept. It's important as well as interesting to discuss and analyze the impact and possible implementation in Indonesia. Through juridical normative approach with descriptive analytical method, the research found that from the substance, structure, and cultural approach, Indonesia still needs several adjustments, renewal, and collaborative strategy to formulate harmonization of regulation, the support from infrastructure technology and human resources, and the formulation of legal culture not just the level of knowledge of society on digital technology and notary, but also the formulation of legal culture in the term of trust and security to the digital environment, digital safety and trust to the notary functionaries. These three need significant renewal formulated in a comprehensive, integrative, reliable, secure, and collaborative system supported by state holders (ministries) and stakeholders to find the balance and intersection, harmonization, and best practice in the implementation of the notary in Indonesia.
