KONSISTENSI PENGATURAN NASIONALISASI (EXPROPRIATION) ASEAN COMPREHENSIVE INVESTMENT AGREEMENT (ACIA) DENGAN HUKUM PENANAMAN MODAL INDONESIA

Abstract

ABSTRAK
ASEAN Comprehensive Investment Agreement (ACIA) merupakan instrumen hukum internasional yang bersifat regional yang secara komprehensif mengatur bidang hukum investasi. Penanam modal asing cenderung memikirkan kepastian hukum ketika investasi yang ditempatkan di suatu negara dinasionalisasi atau diambil alih hak kepemilikannya (expropriation). Artikel ini membahas tentang konsistensi ketentuan-ketentuan tentang nasionalisasi antara ACIA dengan hukum positif yang mengatur investasi, khususnya Undang-Undang Penanaman Modal (UUPM), serta penyempurnaannya. Metode pendekatan yang digunakan ini adalah metode pendekatan yuridis normatif. Hasil penelitian menunjukkan bahwa ACIA dan UUPM adalah konsisten, namun, ketentuan-ketentuan yang tercantum dalam ACIA lebih komprehensif khususnya pengaturan tentang nasionalisasi atau pengambilalihan hak kepemilikan secara tidak langsung dan kompensasi mengenai waktu pembayaran, harga pasar, dan bunga yang dapat diterapkan apabila terdapat penundaan pembayaran.

ABSTRACT
ASEAN Comprehensive Investment Agreement (ACIA) is a regionally international legal instrument, which govern investment law. Foreign direct investor tends to consider legal certainty especially if the investment made in a host country may be expropriated. This article discusses the consistence regarding expropriation under ACIA and Indonesia’s current law, especially under the Investment Law, in addition its consummation. This research is conducted by using normative juridical approach. The paper shows that ACIA and Investment Law of Indonesia is already consistent, however, the provisions under ACIA is more comprehensive, particularly concerning indirect expropriation and prompt payment, market value, and applicable interest when there is delay on the payment for compensation.
