Penyelundupan Benih Bening Lobster (BBL) merupakan permasalahan yang banyak disoroti sejak PERMEN KP Nomor 1 Tahun 2015 dibuat. Maraknya kasus menjadi masalah bagi ekosistem laut. Karenanya, berdasarkan PERMEN KP Nomor 17 Tahun 2021 mengatur mekanisme pelepasliaran barang bukti BBL. Pelepasliaran merupakan pelestarian spesies dengan cara mempertahankan keberadaan suatu spesies dengan menyerahkan perkembangan ke habitat aslinya. Proses pelepasliaran yang dilakukan penyidik perikanan merupakan salah satu cara untuk menegakkan hukum dalam melindungi ekosistem laut. Selain oleh penyidik, peran serta masyarakat untuk menjaga ekosistem laut juga penting. Metode penelitian: yuridis normatif yaitu menganalisis kenyataan dengan aturan hukum yang berlaku. Hasil disajikan dalam bentuk deskriptif untuk menggambarkan permasalahan yang ada yang kemudian dianalisis sehingga menghasilkan suatu kesimpulan. Kenyataan yang ada menunjukkan bahwa penegak hukum dalam proses penyidikan telah secara nyata menerapkan penanganan barang bukti BBL yang mengedepankan asas kelestarian. Tetapi aturan hukum terkait hal tersebut hanya ada pada tingkatan PERMEN bukan dalam tingkatan Undang-undang.

ABSTRACT

Smuggling of Clear Lobster Seeds (BBL) is a problem that has been highlighted a lot since PERMEN KP Number 1 of 2015 was made. The rise of cases is a problem for the marine ecosystem. Therefore, based on PERMEN KP Number 17 of 2021 it regulates the mechanism for releasing BBL evidence. Release is the preservation of species by maintaining the existence of a species by surrendering its development to its natural habitat. The release process carried out by fisheries investigators is one way to enforce the law in protecting marine ecosystems. Apart from investigators, the role of the community in protecting marine ecosystems is also important. Research method: normative juridical, namely analyzing reality with the applicable legal rules. The results are presented in a descriptive form to describe the existing problems which are then analyzed to produce a conclusion. The existing facts show that law enforcers in the investigation process have actually implemented the handling of BBL evidence that prioritizes the principle of sustainability. However, legal regulations regarding this matter only exist at the PERMEN level, not at the Law level.
