Sea Sand Export Policy: A Sustainability Perspective in Spatial Planning Law

Abstract

The reopening of sea sand export permits through PP 26/2023 has sparked controversy for favoring entrepreneurs while harming coastal communities through ecosystem damage, declining quality of life, and income loss.

This article aims to analyzes the politics of law of the sea sand export policy as regulated in PP 26/2023 and examines the sea sand export policy for coastal communities from the perspective of the principle of sustainability in spatial planning law.

This research is a normative legal research that uses a statutory regulatory, conceptual, and case approach.

The politics of law of sea sand export policy is purely instrumentalist, prioritizing short-term economic gains over intergenerational equity and sustainability. Ultimately, the Supreme Court emphasizes that legal policies disregarding environmental protection cannot be sustained within Indonesia’s rule-of-law system.

This policy fundamentally violates sustainability principles in spatial planning. Socioeconomically, marine sand mining offers immediate income but triggers a precarious shift from fishing to labor, causing long-term harm through habitat loss, social conflict, and poverty. Environmentally, the activity inflicts massive damage on coastal ecosystems, destroying mangroves and reefs while degrading water quality. These impacts create sedimentation imbalances, leading to severe erosion, coastal retreat, and disasters like flooding.
