Abstract
This study aims to examine the validity of non-competition clauses in employment contracts for notary office staff from the perspectives of labor law and notarial practice in Indonesia. The primary focus of this study is whether the existence of such clauses conflicts with workers’ rights, as well as the extent of their limitations in notarial practice. This study employs a socio-legal approach, which combines a normative analysis of legislation with an examination of prevailing practices in society. The results of the study indicate that non-competition clauses are generally not in conflict with labor law as long as they meet the legal requirements for a valid contract and do not deprive workers of their right to continue working. However, in the context of notarial practice, the existence of these clauses has stronger justifications, particularly due to the obligation to maintain professional confidentiality, protect the interests of the parties involved, and the nature of authentic deeds, which possess high evidentiary weight. Nevertheless, their application must still be limited proportionally in terms of purpose, scope, and duration to ensure they do not unfairly disadvantage workers. Thus, a balance is required between the protection of legal interests in notarial practice and respect for workers’ rights within the employment relationship.
