ABSTRAK
Undang-Undang Nomor 26 Tahun 2007 Tentang Penataan Ruang sebagaimana Pasal 29 mengamanatkan penyediaan ruang terbuka hijau (RTH) pada kawasan perkotaan. Penyediaan RTH salah satunya RTH Privat didorong penyediaannya dalam kawasan industri. Kota Cimahi merupakan salah satu kota yang harus mewujudkan proporsi RTH kawasan perkotaan dan terdapat perusahaan industri dalam kawasan industrinya yang belum dapat menyediakan RTH Privat sesuai ketentuan akibat pendirian bangunan pabrik sebelum terbentuknya Kota Cimahi. Penelitian ini bertujuan menganalisis implikasi hukum dari pelanggaran koefisien dasar bangunan pada ruang terbuka hijau privat dalam kawasan industri di Kota Cimahi dan pengendalian yang dilakukan oleh Pemerintah Kota Cimahi dalam hal pelanggaran koefisien dasar bangunan pada ruang terbuka hijau privat dalam kawasan industri di Kota Cimahi. Penelitian ini menggunakan metode deskriptif analitis dengan pendekatan yuridis normatif. Berdasarkan hasil penelitian diperoleh hasil yakni pertama, implikasi hukum dari pelanggaran koefisien dasar bangunan pada ruang terbuka hijau privat dalam kawasan industri di Kota Cimahi adalah perlunya penertiban yang dilakukan oleh Pemerintah Kota Cimahi berupa penyesuaian bangunan pabrik Perusahaan Industri dilakukan dengan memberikan ketentuan-ketentuan pada saat permohonan IMB baru atau IUI baru untuk taat pada persyaratan teknis dan persyaratan administratif bangunan gedung serta penyediaan RTH Privat pada bangunan pabrik dengan luasan sesuai arahan persyaratan teknis dari Pemerintah Kota Cimahi. Kedua, pengendalian dari pelanggaran koefisien dasar bangunan pada ruang terbuka hijau privat dalam kawasan industri Kota Cimahi terdiri dari upaya preventif dan upaya represif.

ABSTRACT
The Law Number 26 of 2007 concerning Spatial Planning has mandated in its Article 29, to provideopen green space (OGS) in city area. All construction developer in city area supports the act to provide OGS. Cimahi city is one of many cities that has specific portion of area meant for industry. Industrial company are encouraged to be able to contribute to the act of providing Private OGS. This research aims to understand the legal implication on the breach of building coverage ratio in private open green space in the industrial area of Cimahi City to the conservation of the function of living environment and also the spatial control efforts made by the Cimahi City Government in case of such breach occurrence. This research use descriptive-analytical method with juridicalnormative approach. Based on the research conducted, the result is: first, the legal implication on the breach of Building Coverage Ratio (BCR) in private open green space in industrial area in Cimahi City resulted into the necessity of the Cimahi City Government to enact regulation. The enactment of the regulation is in the form of adjustment of factory buildings owns by the Industrial Company, through the given provisions at the time of new Building Permit (IMB) or Industrial Business License (IUI) application, where the applicant has to comply to the technical and administrative requirements of building construction provided as well as the obligation to provide Private OGS in industrial buildings with the measurement in accordance with the technical specification from the Cimahi City Government. Second, the control efforts to the breach of BCR in Private OGS in Cimahi City industrial area composed of preventive and repressive efforts.
