Abstract

Notary as one of the service providers has legal and moral responsibilities. The era of globalization, which is reflected in the Notary Profession Law, in addition to providing space for Notaries to operate electronic facilities, also expands the authority that is inseparable from legal quality. Through a normative juridical approach with analytical descriptive method, it is found that cyber notary in Indonesia is not pure because it is still based on the principle of Tabellionis Officium Fideliter Exercebo, but on the other hand, integration of Legal Quality Science is needed in order to achieve the implementation of services according to the pillars, namely defect-free, satisfying service users, and continuous improvement. Matters related to the science of legal quality on a national scale that can be used as benchmarks or parameters regarding cyber notary include legal quality in the form of conformity of deeds with regulations and also the evidentiary power of each electronic deed, minimal costs in the form of the difference between costs incurred if they meet offline and online, availability/access in the form of stakeholders who are mandated to assist Notaries who still have difficulty operating electronic facilities as well as socialization related to the management of electronic facilities related to cyber notary to the implementation of periodic assessments related to the readiness of Notaries in implementing cyber notary every few months or years as an effort to keep up with community developments/trends. In this regard, the Ministry of Law and Human Rights needs to form stakeholders who specifically oversee cyber notaries as a preventive, repressive, and progressive effort in order to minimize obstacles related to the use of electronic facilities by Notaries.

R. Shelly Ferawati, Universitas Padjadjaran

R Shelly Ferawati studied undergraduate law at Padjadjaran University. She continued her master of notarial studies at the same faculty and university. She is involved in several researches, one of which is the Concept and Strategy for Implementing Performance Guarantee as the Basis for Financing Digital Micro, Small and Medium Enterprises (MSMEs) in the Marketplace in Indonesia.

Prof. Dr. Tarsisius Murwadji, S.H., M.H. Born in Yogyakarta, 1962. Higher education was completed at 3 State Universities, namely S1 Department of Civil Law at Padjadjaran University Bandung, S2 Concentration of Economic Law at the University of Indonesia Postgraduate Program, Jakarta, and S3: Legal Science, with a Dissertation on Economic Law at the Gadjah Mada University Doctoral Program in Yogyakarta. In 2015 the author was appointed as Professor of Economic Law at the Faculty of Law, Universitas Padjadjaran.

On March 24, 2017 Prof. Dr. Tarsisius Murwadji, S.H., M.H. Conducted an Oration of Professor of Economic Law with the theme: “Integration of Legal Quality Audit in the Development of Indonesian Economic Law”.The author has 40 Creation Rights and 12 Scopus Indexed Journals. Structural positions held are: Head of Master of Law Study Program Unpad in 2014-2016, Head of Department of Economic Law Faculty of Law Unpad in 2016 until now, and Member of Commission C of Unpad Professors Council.
