ABSTRAK
Mengingat pentingnya arti tanah bagi masyarakat dan masih tingginya kasus pertanahan, pemerintah berusaha mengatasi masalah yang timbul mengenai hak atas tanah dengan cara mempertegas kepastian hukum bagi pemegang hak melalui pendaftaran tanah sebagaimana di tegaskan Pasal 19 UUPA. Penelitian ini menggunakan penelitian yuridis normatif yaitu pendekatan pada norma hukum dengan cara meneliti bahan pustaka atau data sekunder. Hasil penelitian Pertama, syarat yang diperlukan dalam pengaturan pendaftaran tanah dengan sistem publikasi positif agar kepastian hukum pemegang hak atas tanah adalah terpenuhinya 4 (empat) prasyarat/prakondisi (pre-requisite condition) yaitu tersedianya Cakupan Peta Dasar Pertanahan 80%, Cakupan bidang tanah bersertipikat 80%, terpenuhinya tata batas kawasan hutan dan non hutan mencapai 50% dan terpenuhinya pemetaan tanah adat/ulayat. Yang tak kalah penting adalah ketercukupan SDM BPN yang berkualitas dan kuantitas yang seimbang guna mendukung kebijakan serta kegiatan pelayanan publik serta tersedianya payung hukum dalam sistem hukum positif atas perubahan sistem publikasi positif dalam pendaftaran tanah. Kedua, potensi masalah yang timbul dalam pengaturan pendaftaran tanah dengan sistem publikasi positif adalah jika terdapat kesalahan/kepalsuan data dalam register maka akan ditanggung oleh negara, berupa pembayaran kompensasi ganti rugi (indemnity). Dengan dipenuhinya prakondisi sebelum menuju pemberlakuan sistem publikasi positif, tingkat kesalahan pada data dalam register yang mengakibatkan beban keuangan negara dalam menyediakan ganti rugi, akan mencapai tingkat resiko yang dapat dikelola dengan baik.

ABSTRACT
Considering the importance of land for human and still high cases in the land sector, the government is trying to overcome the problems that arise regarding land rights by affirming legal certainty for right holders through land registration as confirmed by Article 19 of the Agrarian Basic Law (UPPA). This research uses normative legal research which is an approach to legal norms by examining library materials or secondary data. The results of this thesis research are: First, the requirements needed in regulating land registration with a positive publication system so that legal certainty of land rights holders is the fulfillment of 4 (four) pre-requisite conditions, that is the availability of 80% coverage of land base maps, The coverage of certified land parcels is 80%, the boundaries of forest and non-forest areas are up to 50% and the mapping of customary/ulayat lands is fulfilled. Equally important is the adequacy of BPN's human resources with a quality and balanced quantity to support policies and public service activities as well as the availability of a legal protection in a positive legal system for changes in the positive publication system in land registration. Second, the potential problem that arises in regulating land registration with a positive publication system is that if there is an error/falsification of data in the register, it will be borne by the state, in the form of indemnity compensation payments. By fulfilling the preconditions before leading to the implementation of the positive publication system, the error rate in the data in the register which results in a financial burden on the state in providing compensation will reach a level of risk that can be managed properly.
