ABSTRAK
Pekerja anak dilindungi oleh Pasal 68 s/d 75 UU Nomor 13Tahun 2003 tentang Ketenagakerjaan. Melalui Konvensi ILO No.138 diatur mengenai Usia Minimum untuk diperbolehkan bekerja yang diratifikasi dengan UU No. 20 Tahun 1999 dan konvensi ILO No. 182 mengenai Pelarangan dan Tindakan Segera Penghapusan Bentuk-Bentuk Pekerjaan Terburuk Untuk Anak dengan UU No.1 Tahun 2000. Keberadaan pekerja anak dapat bersifat positif selama orang tua tidak memanfaatkan kemampuan anaknya dengan berlebihan sehingga mengganggu jiwa dan fisiknya. Pada kenyataannya sangat sulit melarang anak untuk bekerja terutama dalam kondisi kemiskinan. Sentra pembuatan sepatu Cibaduyut merupakan sentra industri informal yang salah satu industri memperkerjakan anak, yang mana tidak ada kontrak yang mengatur hubungan kerja antara pengusaha dan pekerja, termasuk pekerja anak. Pendekatan yang digunakan dalam penelitian ini adalah yuridis normatif dan bersifat deskriptif analitis, dengan menggunakan data sekunder sebagai data utama, sedangkan data primer yang diperoleh melalui teknik wawancara hanya merupakan data pendukung atas data sekunder. Hasil dari penelitian ini menunjukan bahwa perlindungan hukum terhadap pekerja anak pada sentra industri pembuatan sepatu Cibaduyut Bandung tidak sesuai dengan peraturan perundang-undangan yang berlaku yaitu UU Nomor 13 Tahun 2003 tentang Ketenagakerjaan dan UU Nomor 35 Tahun 2014 tentang Perlindungan Anak dan Konvensi ILO. Bentuk pengawasan yang dilakukan oleh Dinas Ketenagakerjaan dan Trasmigrasi Kota Bandung tidak maksimal dalam rangka perlindungan terhadap pekerja anak.

ABSTRACT
Child labour is protected by Article 68-75 of Law Number 13/2013 on Manpower, ILO ConventionNumber 138 on the Minimum Age For Admission To Employment and Work (has been ratified by the government of Indonesia and later authorized by Law Number 20/1999), and ILO Convention Number 182 on the Prohibition and Immediate Action for the Elination of the Worst Forms of Child Labour which was authorized by Law Number 1/2000. The role of child labor can be positive as long as their parents don’t take any advantage of their child or exploit them excessively, as it may cause mental and physical disturbance. As the matter of fact, it is extremely difficult to forbid children to work especially in case of poverty. The center of footwear industry in Cibaduyut is an informal industry, so there is no contract between employers and workers, including child. Therefore, this condition has resulted in an absence of employment protection. The approach used in this research is normative and descriptive analytics, using secondary data (both primary legal materials, secondary legal materials and tertiary legal materials) as the main data, while the primary data obtained through interview is solely to support the secondary data.The data were analized qualitatively whit abstract theoretical approach. The results of this research indicate that the legal protection of child labour in the Cibaduyut footwear industry center Bandung is not in accordance with the positive law, namely Act Nomer 13 Year 2003 on Manpower and Act Nomer 35Year 2014 on Protection of Children and ILO Conventions.Suversion of the Ministery of Manpower and Transmigratin Bandung cannot do much.
