Pertanggungjawaban Hukum Perusahaan atas Pencemaran Lingkungan Hidup dalam Tujuan Sustainable Development Goals (SDGS): Perbandingan Indonesia dan Uni Eropa

ABSTRAK
Pencemaran lingkungan hidup akibat aktivitas perusahaan masih menjadi persoalan serius dalam mewujudkan pembangunan berkelanjutan. Permasalahan hukumnya terletak pada belum optimalnya pertanggungjawaban hukum perusahaan dalam mencegah dan memulihkan kerusakan lingkungan, khususnya di Indonesia. Penelitian terdahulu umumnya membahas tanggung jawab korporasi atau hukum lingkungan secara terpisah, sedangkan kajian yang menghubungkan pertanggungjawaban perusahaan dengan tujuan Sustainable Development Goals (SDGs) melalui perbandingan Indonesia dan Uni Eropa masih terbatas. Penelitian ini bertujuan menganalisis harmonisasi keadilan lingkungan dan pembangunan dalam hukum internasional serta membandingkan pengaturan pertanggungjawaban hukum perusahaan atas pencemaran lingkungan hidup di Indonesia dan Uni Eropa. Penelitian ini menggunakan metode yuridis normatif dengan pendekatan peraturan perundang-undangan, konseptual, dan perbandingan. Temuan penelitian memperlihatkan bahwa Indonesia telah memiliki dasar pengaturan yang cukup lengkap, namun Uni Eropa lebih efektif karena menerapkan model yang preventif, restoratif, dan terintegrasi.

ABSTRACT
Environmental pollution caused by corporate activities remains a serious issue in achieving sustainable development. The legal problem lies in the fact that corporate legal liability has not yet functioned optimally in preventing and remedying environmental damage, particularly in Indonesia. Previous studies generally examine corporate liability or environmental law separately, while studies linking corporate liability to the Sustainable Development Goals (SDGs) through a comparison between Indonesia and the European Union remain limited. This study aims to analyze the harmonization of environmental justice and development in international law and to compare the regulation of corporate legal liability for environmental pollution in Indonesia and the European Union. This study applies a normative juridical method through statutory, conceptual, and comparative approaches. The results show that Indonesia already has a relatively comprehensive legal framework, but the European Union is more effective because it applies a preventive, restorative, and integrated model.
